BasicMed Expanded to Six Passengers and 12,500-Pound Aircraft

Rule · Nov 18, 2024

The Federal Aviation Administration (FAA) published a final rule titled "Regulatory Updates to BasicMed" in the Federal Register on November 18, 2024. This rule, identified as document 2024-26935, implements sections 815 and 828 of the FAA Reauthorization Act of 2024 without interpretation. The rule took effect on the day it was published.

The regulation amends 14 Code of Federal Regulations (CFR) parts 11, 61, 68, and 91. These changes align aircraft conditions and limitations with the statutory definition of "covered aircraft." Consequently, the maximum number of allowable passengers increases from five to six, and the total number of occupants rises from six to seven. The maximum takeoff weight limit rises from 6,000 pounds to 12,500 pounds. The rule explicitly excludes certain transport category rotorcraft from these expanded limits.

The FAA also updated the medical examination standards. The rule facilitates changes to the comprehensive medical examination form that a State-licensed physician uses during the evaluation process. Additionally, the regulation expands medical eligibility to include examiners conducting practical tests or proficiency checks. These examiners must meet the specific requirements for operating covered aircraft under BasicMed to qualify.

This final rule addresses Docket No. FAA-2024-2580 with Amendment Nos. 11-70, 61-158, 68-3 and 91-380.
